South African spousal visas: separate the relationship from the permission you need

“Spousal visa” is a useful search term, but it can hide two different questions: what permits you to live with your South African spouse or partner, and what permits your intended work, business or study? Official mission guidance distinguishes a relative's visa from a section 11(6) visitor's visa for a qualifying spouse. Start by identifying the proposed category and activities, rather than assuming the everyday label gives unrestricted permission. [B02, B03]

Who is this guide for?

This page is for a foreign spouse or life partner of a South African citizen or permanent resident. If your partner is a foreign national temporarily in South Africa, begin with the family overview and the principal person's route instead. The status of the person you are joining is a key distinction; “my partner lives in South Africa” is not precise enough to select the route.

What is the difference between a relative's visa and section 11(6)?

The relative's route is based on the family connection. Section 11(6) is specifically relevant to a qualifying spouse and may address proposed work, business or study authorisation. Washington's April 2026 checklist expressly treats it as a spouse-specific category and lists activity-related evidence. It is a Washington submission checklist, not a universal filing instruction. [B03]

Ask whoever advises on your case to name the statutory category, requested activities and actual permission to be sought. A helpful answer explains all three in ordinary language. If someone says “you can work because you are married,” ask where that activity is authorised and what evidence is needed before it starts.

Married couples and unmarried life partners: evidence needs context

For a married couple, begin with the marriage record and any earlier divorce or death records relevant to civil status. For an unmarried couple, prepare a factual chronology of the relationship and shared responsibilities. Official checklists include relationship affidavits and supporting records. Canberra's checklist, for example, asks life partners for a notarial contract and evidence of two years of shared residence. That is evidence of the mission's published instructions, not a conclusion that a particular couple qualifies. [B02]

A useful private inventory has three columns: evidence already available, gaps to explain, and format to confirm. Examples might include a joint lease, records of shared financial responsibilities or evidence explaining a period spent apart. These are discussion prompts, not a promise that any particular document is sufficient. Do not alter records or manufacture a shared history to fit a checklist. If circumstances do not match the apparent requirements, take that difficulty into the professional review rather than hiding it.

Keep sensitive relationship records off public tools. A preparatory question can say “we have lived apart for part of the relationship” without attaching private correspondence or identification.

Work, business or study: say what you actually intend to do

An employment offer, a business plan and an institution's acceptance letter describe different proposed activities. Washington's section 11(6) checklist asks for activity-specific material where applicable, including employer, business or educational evidence. Confirm the correct evidence and conditions for the actual activity and your receiving authority. Do not copy another person's endorsement request without reviewing its fit. [B03]

If work is essential to your household budget, assess the move without assuming permission or income will begin on your preferred date. Use the cost planning guide to separate authority charges, document costs and any professional fees. Ask for the total scope and exclusions in writing. No universal quotation or completion date follows from the name “spousal visa.”

Applying inside South Africa and changes in the relationship

Avoid advice that says every spouse must leave the country to change status. In *Nandutu*, the Constitutional Court addressed the exclusion of foreign spouses and children of South African citizens or permanent residents from exceptional circumstances for in-country status changes. That does not make every application, overstay or travel plan lawful automatically. Have your current documents and proposed next step reviewed. [B04]

If a relationship has ended, particularly where there are South African children, seek individual advice rather than assuming an immediate identical outcome for everyone. *Rayment* addressed constitutional restrictions affecting parents following the end of a good-faith spousal relationship. The judgment should inform the review; a generic website cannot apply its facts and remedies to your household. [B05]

A fictional preparation example

Illustration only — no client or approval outcome. A foreign spouse has an employer interested in hiring them when they join a South African partner. Their first question is “How quickly can I get a spousal visa?” They improve it to: “Which category and work authorisation fit this proposed role, can I apply from my present position, and what must the employer supply?” They also ask what happens if the preferred start date is too early. This produces a more useful discussion without predicting the decision.

Common questions

Are life partners automatically excluded because they are not married?

Official guidance includes life-partner evidence. The applicable relationship definition, duration and evidence must be reviewed for the individual couple; a relationship label alone does not establish the result. [B02]

Is a medical report still required?

Directive 10 of 2026 waives the medical-report requirement under the specified visa and permanent-residence regulations for future and pending applications. Older mission checklists may still list it. Confirm implementation with the receiving authority; do not equate a medical-report waiver with the removal of separate medical-cover requirements. [B06]

Does a spousal visa automatically become permanent residence?

Do not treat a temporary visa as a permanent-residence approval. Establish the separate route, evidence and timing with a qualified reviewer. The residence overview helps frame that next research question.

Will a receipt let me start work?

Do not use a receipt as your work-authorisation conclusion. Ask the reviewer to check the actual status, conditions and any relevant directive before you rely on a proposed start date.

Prepare the conversation before the application

Write down the anchor person's status, the relationship basis and the exact activities you want authorised. Then use the first conversation guide. If comparing assistance, ask the scope and responsibility questions before paying. This page offers general preparation, not a finding on your relationship or a promise of Karoo representation.
