South African tax residence: your visa is only part of the picture
A visa, a permanent-residence permit and a SARS tax number answer different administrative questions. None should be used on its own to decide your tax residence. Your home, mode of life, travel history and any applicable treaty need the appropriate assessment.

Before you start
This guide concerns an individual’s tax-residence starting point. It is not a status calculator or a personal tax opinion. If you need to obtain a number or access SARS services, use the separate tax-registration guide.
Why the distinction matters
SARS explains that South African tax residents are generally taxed on worldwide income, subject to exclusions or exemptions, while non-residents are generally taxed on South African-source income. Residence therefore matters before assuming how overseas earnings, local income or a change of home should be reported. [B04C01]
Do not begin by looking for a label that produces the lowest apparent bill. Start with the facts and have the consequences assessed. Registration, immigration permission, exchange-control treatment and tax residence should not be casually substituted for one another.
1. Ordinary residence is a factual enquiry
SARS Interpretation Note 3 describes ordinary residence through the concept of a person’s usual or principal home, assessed from the circumstances as a whole. A person’s intention and the objective way they live matter; a single travel count does not replace that enquiry. [B04C02]
Prepare information about where you maintain a home, where your household lives, where your personal belongings and working interests are, and why you travel. Include facts that do not fit your preferred answer. Owning a home in one country or having permission to live in another is something to examine, not an automatic conclusion.
2. The physical-presence test has several parts
For an individual not ordinarily resident during the relevant year, SARS describes a physical-presence test requiring presence exceeding all three periods:
- 91 days in the year of assessment being considered;
- 91 days in each of the five preceding years of assessment; and
- 915 days in total over those five preceding years.
All parts matter. This is not a general rule that anyone spending a single period of 183 days in South Africa becomes a tax resident, or that anyone below that number cannot be one. [B04C03]
Use a complete travel record and the correct years of assessment. Do not enter approximate dates into an informal calculator and treat the answer as advice. The ordinary-residence enquiry and any treaty position must still be considered in the proper order.
3. A treaty may affect the result
SARS explains that a person deemed exclusively resident in another country under an applicable double-tax agreement is excluded from the South African definition of resident. The relevant agreement and facts need to be examined; this is not an automatic exemption for anyone with foreign citizenship or a foreign tax number. [B04C04]
Record which other country may regard you as tax resident and why. Gather existing tax-residence certificates, assessments or correspondence without assuming that one document settles every year or income category. Ask the adviser which treaty, if any, applies and what evidence supports the conclusion.
If you leave, establish how residence would cease
Cessation depends on the basis of your residence. For ordinary residence, SARS considers whether intention to stop making South Africa your real home is supported by objective facts. It separately describes a continuous absence of at least 330 full days for a person resident through the physical-presence test, with deemed cessation from departure. The 330-day rule is not a universal exit rule for everyone. [B04C05]
SARS requires a change of tax-residence status to be declared and describes the RAV01 process and supporting evidence. Cessation can have tax consequences, so establish the correct basis and date rather than simply selecting a date in a form. [B04C06]
Prepare a useful evidence file
| Record | What to include | Why it helps the discussion |
|---|---|---|
| Travel history | Dated arrivals and departures, with supporting records | Allows the relevant periods to be checked |
| Homes | Availability, use and changes over time | Shows the reality behind an address |
| Household | Where close family lives and how that changed | Adds context to your mode of life |
| Work and income | Activities, work location and continuing interests | Separates the residence question from income treatment |
| Other-country position | Authority correspondence and existing assessments | Identifies potential treaty and consistency questions |
| Previous declarations | What SARS was told, when and on what basis | Helps identify corrections or updates to investigate |
Keep sensitive documents secure. For an initial enquiry, describe the records and the question rather than sending an entire financial history to an unverified contact.
Worked example: the wrong shortcut
Fictional preparation example, not a client case or tax finding. Daniel moves between South Africa and another country. He assumes that spending fewer than 183 days in South Africa resolves his position, even though his household and available home remain there.
He replaces that shortcut with a timeline of travel, homes, family and work. He includes prior years rather than only the current trip. He asks a qualified tax professional to assess ordinary residence first, any relevant physical-presence test and the treaty position. The exercise produces an assessment question, not a preselected “non-resident” answer.
Common questions
Does permanent residence automatically make me tax resident?
Do not treat the immigration document as the whole tax test. The permanent-residence guide addresses a separate permission and application process.
Does leaving South Africa automatically end my tax obligations?
No. Establish the residence position, any cessation consequences and continuing South African-source income questions. A departure is a fact to assess, not a universal tax clearance.
Can I rely on the same answer indefinitely?
Review material changes in home, family, travel, work or treaty circumstances. An answer based on one period should not silently be applied to a different one.
Your next useful step
Prepare the evidence table and write the exact question you need assessed: arrival, ongoing residence, departure or return. Take the tax question to an appropriately qualified professional. Use prepare your first immigration conversation separately for the permission to live or work.
