South African citizenship: first establish which question you need answered

Citizenship is not another name for permanent residence. A permanent resident considering naturalisation, someone born to a South African parent and a South African affected by the former automatic-loss rule need different enquiries. Start by separating whether you are already a citizen, whether your records need confirmation, and whether you need to apply to acquire citizenship. A passport expiry or an old letter does not, on its own, answer all three.

Citizenship and permanent residence are separate

South African legislation distinguishes citizenship by birth, descent and naturalisation. The applicable route can depend on the person's birth date, parents' status and the law applying at the relevant time. Do not use birthplace or a parent's current passport as a complete answer without checking those facts. [B02B01]

If your question is how to live in South Africa as a foreign national, begin with the permanent-residence overview. If you already hold permanent residence and want citizenship, make clear that you are asking about naturalisation rather than renewal of a visa. If a child is involved, establish the child's position individually instead of assuming every family member has the same status.

What changed in the 2025 citizenship judgment?

On 6 May 2025 the Constitutional Court, in *Democratic Alliance v Minister of Home Affairs*, held section 6(1)(a) of the Citizenship Act unconstitutional. That was the provision causing automatic loss when a South African acquired another citizenship without prior retention permission. The Court's result, as explained in its official record and DHA's implementation statement, treats people who lost citizenship under that provision since its commencement on 6 October 1995 as not having lost it. [B02B02, B02B03]

The old instruction “get retention permission or automatically lose South African citizenship” must therefore not be used as current general guidance. But this is a specific judgment about a particular loss provision. It is not a declaration that every former citizen, every descendant or anyone with an old South African document has the same position.

The current DHA reinstatement portal expressly excludes voluntary renunciation and loss through conversion before 6 October 1995 from this judgment's reinstatement process. If either may describe your history, ask about the correct separate procedure rather than selecting a portal answer that does not fit. [B02B04]

Legal status and administrative confirmation are different tasks

DHA launched a confirmation/reinstatement portal in November 2025 and announced its final phase in February 2026. The official platform provides a way for affected people to check status and, where applicable, obtain administrative confirmation. Using that process is different from making a new naturalisation application. [B02B03, B02B05]

Use the official DHA citizenship-reinstatement portal directly. It requires an account before status verification; its described steps include identity and biometric verification where applicable. Do not send those records to an educational site or a third party simply to find out what the process is. [B02B04]

Keep any reference and outcome privately. If the system's record does not match your history, preserve the discrepancy and seek clarification through the official process or an appropriately qualified professional. Do not treat an online error as a legal determination that citizenship was lost.

If you are considering naturalisation

Naturalisation has its own statutory and documentary requirements. The enacted June 2023 amendment to the citizenship regulations specifies five years of ordinary residence immediately preceding the application for the period referred to in section 5(1)(c). It also addresses evidence such as permanent-resident identification, employment and travel records. That is not a promise that five years since arrival, or five calendar years since a document was issued, settles eligibility. [B02B06]

Prepare a dated residence-and-travel chronology rather than rounding absences or guessing what “ordinary residence” means for you. Ask the reviewer to explain the applicable residence test, relevant absences, supporting records and the decision process. Your position under another country's nationality law also needs checking with an appropriate authority; this page does not tell you to renounce another citizenship.

Put the right records beside the right question

A fictional example: the wrong starting form

Illustration only — not a client or successful reinstatement story. A South African who acquired another nationality in 2008 finds an old letter referring to automatic loss. They initially plan to submit a naturalisation application. After reading the judgment's scope and the current official portal explanation, they instead assemble the relevant dates and check the confirmation process. They do not assume an expired passport proves a final answer, or that the portal covers a relative who voluntarily renounced. The useful outcome is choosing the correct question before starting paperwork.

Questions people ask

Does permanent residence automatically become citizenship?

Treat them as separate statuses and processes. Ask about the applicable naturalisation requirements rather than assuming time alone changes the document you hold. [B02B01, B02B06]

Do I still need the old retention letter?

Do not rely on the former section 6(1)(a) automatic-loss rule as current law. Check the specific judgment and current DHA confirmation guidance. Other citizenship events and another country's rules require separate attention. [B02B02, B02B04]

Can everyone who renounced use the reinstatement portal?

No. The portal explicitly excludes voluntary renunciation from this judgment's process. Ask which separate procedure, if any, applies. [B02B04]

Can I travel immediately on whichever passport I have?

Do not infer travel-document permission from this overview. Establish your confirmed status, valid documents and the current entry/exit instructions directly with DHA or the relevant South African mission before travel. A citizenship question and a passport application are connected but distinct tasks.

Your next useful step

Write a one-sentence question: “I need to establish existing status,” “I may fall within the 2025 judgment,” or “I want to explore naturalisation.” Add the relevant dates and use the first-conversation preparation guide. If comparing professional help, clarify the responsible person's remit and scope. No citizenship assessment, representation or outcome is offered by this page.
