Changing to a study visa: check your current status before choosing where to apply

An offer from a South African institution does not by itself answer whether you may apply for study permission from inside the country. Start with the visa you currently hold, its conditions, your immigration history and any specific exception that applies to you.

Before you start

Three questions need separate answers: may you lodge the proposed application here, do you meet the study requirements, and what allows you to remain or undertake the activity while a decision is pending? Treating those as one question can leave an important gap.

The starting rule is not the same for every visa holder

Section 10(6) distinguishes visitor's and medical-treatment visa holders from other visa holders. It allows an in-country change application subject to the Act for the latter group, while the former need prescribed exceptional circumstances. An application remains subject to the requirements that govern it. [B06C03]

For visitor's visa holders considering study, Regulation 9(9)(a)(ii) identifies an accompanying spouse or child of a business- or work-visa holder who wishes to apply for a study or work visa. This is a defined family circumstance, not a general conversion route for every visitor. [B06C04]

The May 2024 amendment added visitor-holder circumstances covering a spouse or child of a South African citizen or permanent resident, and a parent of a citizen or permanent-resident child. Those additions must be read with the rest of the application requirements and the person's actual circumstances. [B06C05]

This page identifies the provisions most relevant to common study enquiries; it is not an exhaustive account of medical, litigation or other exceptional situations. If none of these descriptions clearly fits, do not manufacture an exception around the urgency of a course start date. Have the lawful application location assessed before relying on an in-country plan.

Make a status factsheet before collecting a second checklist

Bring copies of the documents, rather than describing your permission as "a tourist stamp" or "a dependant permit". Those phrases can conceal distinctions that matter.

Comparison of Fact, What to record, Why it matters to the review
FactWhat to recordWhy it matters to the review
Current permissionExact category, endorsement, issue and expiry detailsEstablishes the starting point for the proposed change
Entry and historyEntry stamp, earlier outcomes, renewals and relevant departuresHelps identify gaps or assumptions about lawful admission
Family basis, if relied onRelationship and the relevant person's citizenship, residence or visa evidenceConnects the claimed exception to actual records
Intended studyInstitution, programme, acceptance status and datesMakes the proposed new activity specific
Outstanding applicationsSubmission record, category, date and outcome if anyPrevents one pending matter being mistaken for another permission
Time pressureCurrent expiry, registration date and any travel plansAllows the adviser and institution to address incompatible dates

If a document is missing, say so. If an application was refused, include the decision and its date. A review based on only the most recent successful visa can miss the question that now needs attention.

Permission to submit is not permission to stay or begin studying

Section 10(8) states that a change application does not itself provide status or a right to remain pending the decision. Do not assume that a booking, payment or submission receipt replaces the permission needed for your stay or intended activity. [B06C06]

Ask for a clear account of your position both before and after the present visa expires. Where someone mentions a concession or court decision, ask which exact instrument applies to your category and circumstances, for what period, and with what limits. A notice about a particular group cannot be treated as a general study-switch entitlement.

Time limits, lawful-admission requirements, the filing channel and any applicable exceptional facts need to be checked together. An institution's willingness to keep a place open does not settle those immigration questions. Where expiry is approaching or has passed, obtain prompt case-specific advice rather than using a general article to choose a travel or filing step.

Coordinate with the institution without promising an arrival date

Once the application-location question is understood, ask the institution for the precise documents it can issue and the latest date at which registration remains possible. Record who may approve a deferral, whether a changed start date requires a revised letter, and the consequences under the actual payment or accommodation terms.

An acceptance letter supports the study case; it does not cure a defect in the proposed filing location. Equally, falling within an in-country exception does not replace acceptance, funding or the remaining study evidence. Use the university guide or school-student guide for that separate preparation.

A fictional comparison

Leila holds visitor permission and has received a university offer. She is accompanying her spouse, whose current work visa she can document. She puts Regulation 9(9)(a)(ii) on the questions for review and gathers the relationship and visa evidence. The provision is relevant to assessing an in-country application; it is not an approval result.

Another applicant, Tomas, also has visitor permission and an offer, but has no identified circumstance matching the exceptions discussed here. The same course does not put him in Leila's position. His next task is to establish the appropriate application location, not to copy her submission plan. Both applicants need separate answers about current stay, course timing and the substantive study requirements.

Common questions

Can I enter as a visitor and convert once I receive an offer?

Do not build a study plan on that assumption. The current category and any legally relevant exception must be checked. An offer alone is not the exceptional circumstance described above.

Does a South African family relationship guarantee a study visa?

No. The family provisions concern the in-country application restriction. The relationship, status evidence, actual facts and study requirements still need assessment.

Can I use an old checklist or someone else's successful application?

Use them only as leads to investigate. Ask which legal text and current administrative instructions govern your own application, including any later amendments. Similar-looking cases can start from different permissions.

Your next useful step

Prepare the status factsheet, current visa and acceptance documents. Use preparing your first immigration conversation to organise the unresolved questions, and the study overview to understand the wider preparation.
