Hiring or transferring staff to South Africa: an employer coordination guide
An employer's immigration task continues beyond supplying an offer letter. Section 38 addresses authorised employment, good-faith status checks, prescribed records and reporting. [A03] The practical job is to make those responsibilities visible across HR, the hiring manager, the employee and whoever reviews the immigration position.

Before you start
This guide sets out a coordination method. It does not certify compliance, choose a visa or offer Karoo representation.
Start with the job and the actual employer
Write down the legal employing entity, work activities, location, intended period and reporting line. Distinguish local recruitment from a transfer within a business group. Then identify who will review the arrangement against the relevant immigration category; the work overview explains the initial differences.
Avoid a file labelled only “international hire”. That can conceal very different questions: who employs the person, whether there is a related overseas operation, which position is proposed and whether the permission being examined matches the work. An organisation chart and clear job description are practical aids, not substitutes for the legal assessment.
Check permission against the work, not merely the document's existence
Section 38 prohibits employment where status does not authorise that employer or where the terms, conditions or capacity differ from those authorised. It also requires a good-faith effort to ascertain the relevant status or citizenship. [A03] A document in a folder is therefore not the same question as permission for this actual position.
Give the check a named owner. Keep a dated note of the issue examined and where unresolved questions were referred. If the role, entity, working arrangement or proposed start changes, return the change to that owner for review. Do not let an internal start-date request stand in for permission to work.
Use a responsibility board
| Workstream | Suggested coordinating owner | Evidence or output to agree |
|---|---|---|
| Role and entity facts | Hiring manager with HR | Clear role, employing entity and assignment description |
| Immigration position | The person appointed to review it | Relevant category, applicable conditions and unresolved legal issues |
| Employer supporting information | Named HR or authorised company contact | Correct particulars, supporting letters and undertakings where applicable |
| Applicant information | Employee through an agreed secure channel | Requested personal evidence and questions requiring clarification |
| Onboarding checkpoint | HR with the responsible reviewer | Actual permission and remaining steps checked before work begins |
| Changes, expiry and departure | Named continuing owner | Review dates, escalation route and required notifications |
This is a proposed management method, not a statutory allocation of liability or a guarantee that a file is complete. Appoint actual owners rather than assuming that “the adviser” or “the employee” covers every item.
Maintain the records the rules describe
Section 38 includes retention of prescribed records for two years after termination and reporting termination and breaches of status. [A03] Regulation 35 describes the record categories: certified passport particulars, relevant visa or permanent-residence permission, employment capacity, and earnings/job-description records. [A02]
Treat those records as controlled employment information. Decide who genuinely needs access, where documents belong and how the applicable retention and privacy obligations will be reconciled. This reading site is not an employee-document collection channel. A broad shared folder or ordinary enquiry attachment should not become the default simply because it is convenient.
Transfers require coordination between two entities
For an intra-company transfer, the regulation calls for evidence from the company abroad and the receiving South African operation. [A02] Agree which contact checks consistency across those descriptions and who owns the receiving employer's commitments. The transfer guide covers the route's distinct evidence and limits; this employer page owns the coordination around them.
For local recruitment, do not copy a transfer pack as a shortcut. Identify the actual category and current supporting requirements. For example, DHA's general-work checklist includes employer undertakings concerning passport validity, specified deportation costs and non-compliance reporting. [A09] Read the whole applicable instruction and check later directives rather than assuming one letter covers every category.
Trusted Employer status is not a blanket permission
The July 2026 Phase II notice describes a selection process for corporate employers. Its stated expression-of-interest closing date was 4 September 2026. The notice also distinguishes selection from an employer's wish to participate. [A06] This page therefore does not describe that round as open or assume an organisation is admitted.
Keep employer membership evidence separate from an employee's visa evidence. Where a concession is claimed, ask for the exact scheme or waiver instrument and whether it applies to this application. An application to join a scheme is not proof of membership, and membership should not be used as an instruction to ignore individual requirements.
Avoid planning from obsolete paperwork or policy headlines
The July 2026 medical-report directive is a useful example of a later instrument affecting an older application list. [A04] Have one owner reconcile changes and preserve the reason for each checklist update. Do not silently delete a requirement because a blog said it changed, or insist on an old item without checking the current authority.
The April 2026 White Paper announcement describes policy reforms and legislative work to implement them. [A07] For an operating decision, identify the actual instrument and its commencement rather than using a policy headline as permission.
Fictional example: a job change returns to review
A company has a staff member preparing for a defined specialist role. Before onboarding, a manager proposes a different role in another group entity. The coordinator records the change and asks the responsible reviewer to examine the actual permission and new arrangement. The team does not assume that group ownership settles the question. This fictional example illustrates a review checkpoint, not a finding that a particular change is allowed or prohibited.
Questions people ask
Does outsourcing administration remove the employer's duties?
Section 38 places duties on the employer. [A03] A written scope should explain which tasks a provider performs and which actions remain internally owned. See choosing immigration assistance.
Can an appointment receipt determine a work start date?
Do not treat evidence that an administrative step occurred as a determination of work permission. Have the actual status, conditions and any applicable interim authority reviewed. This page does not decide the effect of a pending application.
How should we budget for a hire or assignment?
Separate the agreed professional work, official application charges and other costs relevant to the actual case. Use the cost questions guide; do not present an internal estimate as an official fee or guaranteed total.
What should a first coordination meeting produce?
A role/entity summary, named evidence owners, unresolved questions and the next review checkpoint. Use the conversation preparation guide to make those questions concise. It is possible to prepare a useful meeting without putting employee identity records into a general enquiry.
