South African intra-company transfer visa: evidence and limits

An intra-company transfer work visa concerns a transfer from a company abroad to its South African branch, subsidiary or affiliate. The regulation calls for the overseas employment contract and confirmation from both companies. It caps the visa at four years and states that it is not renewable. [A02] This is a route to examine for a real group transfer, not a general label for anyone taking a South African job.

Before you start

Use this guide to understand the transfer evidence and the assignment's limits. Your actual company relationship, employment history and circumstances still need individual review.

The transfer has two sides

The overseas company needs to explain the proposed transfer; the receiving South African operation needs to confirm it and identify the occupation and capacity. The employment contract abroad must satisfy the regulation's requirement for a period of not less than six months. [A02]

That wording matters. This guide does not turn it into a universal answer about how a particular contract or employment history will be assessed. Assemble the dates and contract terms accurately and have the actual facts checked. A shared trading name, commercial partnership or common customer is not, on its own, a researched finding that your entities meet the branch, subsidiary or affiliate relationship.

Create a one-page assignment summary before asking either company for letters:

  • Which legal entity employs the person abroad?
  • Which legal entity will receive the person in South Africa?
  • What is the proposed relationship between those entities, and what evidence explains it?
  • What occupation, responsibilities and assignment period are proposed?
  • Which facts and dates remain unconfirmed?

This summary is an organising tool. It is not an official form or a complete document checklist.

What the receiving employer must address

The standard regulation addresses employment in the specific position, compliance with the visa conditions, notification if the employee refuses to comply, a skills-transfer plan for a South African citizen or permanent resident, and an undertaking about specified deportation costs. [A02] These are substantive commitments; do not leave them to an unnamed signatory after the assignment has already been scheduled.

The practical preparation is to name the person who owns each commitment. A skills-transfer plan should have a responsible manager and a clear proposed activity, rather than a line copied into a letter without an owner. This is a preparation recommendation, not a new legal template. If a waiver or scheme-specific concession is claimed, obtain the exact applicable written authority; ordinary employer membership or an assumption about a scheme does not establish a waiver for this assignment.

The time limit affects the whole assignment

Do not plan on renewing this visa at the end of four years. That ceiling and non-renewability are part of the published regulation. [A02] A project that could continue beyond the assignment should have an early review point for what happens next. This page does not promise an extension, a new visa, an in-country change or a permanent-residence pathway.

The visa is also tied to the authorised employer and its stated requirements under section 19(6). [A03] If the proposed employer, position or assignment changes, obtain advice on the actual permission before treating the new arrangement as covered. An internal HR approval does not amend a visa.

Use a current application pack

Start with the relevant submission location's current instructions and check later national instruments that affect them. The official Canberra page describes this transfer category and its supporting evidence, but its appointment procedure, local charges and advertised processing time concern that mission. They are not universal South African instructions. [A08]

A specific example of why dates matter: the July 2026 directive waives the specified medical-report requirement for temporary visas and permanent-residence applications within its scope. [A04] A legacy checklist that still asks for that report needs reconciliation with the directive. The waiver is not a reason to omit other evidence without checking.

Keep three preparation lists: company evidence, applicant evidence and items awaiting clarification. Record the source and checked date alongside each. Do not send passports, contracts or identity records through a general reading tool.

Fictional example: finding a missing company confirmation

A systems specialist is discussing an 18-month assignment between an overseas employer and its South African subsidiary. HR has an overseas letter, but the receiving operation has not confirmed the occupation and responsibilities. The useful action is to resolve that missing confirmation and reconcile the two companies' descriptions before treating the evidence pack as ready. The example is fictional; its facts do not prove that an application would succeed.

Costs, family and start dates need separate attention

Build the assignment budget from a written assistance scope and current official charges. The cost guide helps separate confirmed amounts from unresolved items. Neither a price nor an expected processing period resolves the transfer test.

If family members may accompany the employee, identify their questions separately. An employee's transfer discussion does not answer each accompanying person's permission or work question. Start with the family overview; do not assume the assignment letter covers the household.

Keep travel and onboarding conditional on clarification of the actual permission and any required next step. The application-process guide separates preparation from a decision and implementation.

Questions people ask

Can I use this route for an unrelated local employer?

The transfer regulation describes a branch, subsidiary or affiliate relationship with the company abroad. [A02] An unrelated hiring arrangement needs a different route analysis; compare the work overview.

Is four years guaranteed?

No. Four years is the maximum in the regulation, not a promise of the period granted in an individual case. [A02] Read the actual decision and conditions.

Is the transfer covered by the general-work points table?

The 2024 points notice names general work and critical skills visas. [A01] Do not replace ICT evidence with a score or use the table to decide a transfer application.

Can this page confirm a skills-transfer exemption?

No. The base rule contains the skills-transfer-plan requirement. [A02] Any claimed departure from it needs the exact applicable waiver or other authority checked for the employer and application.

Prepare a focused transfer conversation

Keep your company relationship, assignment summary and missing evidence questions in your own notes. Use prepare your first conversation or the employer coordination guide to agree who will resolve each unknown.
