South African immigration research

Investing in South Africa: what are you buying, and what will you do here?

You might want to fund a business, buy a home or become an active owner of a South African company. Those plans raise different questions. Start with the asset or business you want to acquire, then describe the activities you personally intend to carry out in South Africa.

Before you start

A company record or property transfer is not a visa decision. DHA describes immigration permission by purpose and category; CIPC verifies company participants, while the Deeds Registry records property rights. Treat these as separate approvals and records rather than assuming that one replaces another. [B02C01]

Separate four decisions

Comparison of Decision, What you need to establish, What it does not settle
DecisionWhat you need to establishWhat it does not settle
The investmentWhat you acquire, the funding source, risks and contractual obligationsWhether the investment is suitable for you
The companyOwnership, directors, registration and ongoing corporate obligationsYour permission to live or work in South Africa
Your immigration planWhat you will do, for how long, and which category fitsThe commercial quality of the business
Tax and cross-border moneyApplicable registration, reporting and transaction requirementsA guaranteed return or permission to perform an activity

Use a separate question list for each. Ask who is responsible for answering it and what evidence they will examine. An attractive sales presentation is not an assessment of all four decisions.

When a business-visa assessment is relevant

DHA’s business-visa guidance addresses establishing or investing in a business and refers to a prescribed capital contribution, financial evidence, employment commitments and a departmental recommendation. This is a category-specific application, not a rule that every purchase of an asset qualifies for residence. [B02C02]

The dtic currently issues business-visa recommendations through its Visa Recommendation System. Its guidance separates first applications, extensions and permanent-residence recommendations and lists different supporting records. A recommendation process is one part of an immigration application; do not describe it as the visa itself. [B02C03]

Before commissioning a detailed application, write down your intended ownership share, management role, location, sector, funding and proposed staffing. Explain whether you will manage the business yourself, work in a defined role or remain an investor abroad. Have the actual activities assessed rather than relying on the word “investor”.

Company registration has its own identity checks

CIPC’s foreigner-assurance guidance describes identity verification for people using a passport or foreign identity document in its relevant services. It exempts foreign nationals with a South African ID from that assurance service because they have already been verified through DHA. Recorded details must match the identification. This is a corporate identity check, not a grant of immigration permission. [B02C04]

Prepare consistent names and identification across your proposed corporate, banking and immigration records. If you already own an overseas company, make that clear rather than assuming that setting up a new local company is the only structure available. Obtain appropriate company and tax advice before choosing the structure.

Buying a home is a different project

A home purchase needs its own contractual, funding and transfer checks. It should not be sold to you as a substitute for establishing your immigration route. Use the property-purchase guide to prepare questions for the property professionals and keep those questions separate from how you will enter, stay or work.

If your aim is retirement, read the retirement overview. If you are exploring a long-term status, read the permanent-residence overview. These are different starting points, not an invitation to choose whichever application seems easiest.

Worked example: a café and an apartment

Fictional preparation example, not a client case or investment recommendation. Noor is considering buying shares in a café and an apartment nearby. The seller tells her that owning both will make moving straightforward.

Noor separates the projects. For the café, she asks for the accounts, ownership documents, liabilities and proposed role she would perform. For the apartment, she has the proposed contract and transfer arrangements assessed. For immigration, she describes the daily work she hopes to do and her intended stay. She also asks a tax professional about her own and the company’s obligations.

She does not treat the combined purchase price as proof of immigration eligibility. Her next decision is whether the evidence supports proceeding with each project, including what she would do if the immigration outcome differs from her plans.

Questions worth answering before you commit

Is there a universal investment amount that buys residence?

Do not use an advertised figure that way. A prescribed amount belongs to a particular category and must be read with that category’s other conditions. This page gives no investment threshold or assurance of approval.

Can I start managing the business while the application is considered?

Have your intended activities checked against the permission you currently hold. A pending application or company appointment should not be used as your answer to that question.

Who should assess what?

An immigration assessment should address your proposed activity and status. Company, transaction, tax and financial questions require the appropriate professional scope. Ask each adviser to explain what is included and what remains someone else’s responsibility.

Your next useful step

Prepare a one-page description of the transaction and your intended role. Use prepare your first immigration conversation for the immigration questions and the costs guide to compare quoted work. Keep capital invested, transaction costs and professional fees in separate budget lines.
