Buying a South African property: keep the purchase and your permission to stay separate

Finding a home can make a move feel real. Before the excitement becomes a binding commitment, establish what needs to happen for the purchase and what needs to happen for you to live there as planned.

Before you start

The Deeds Registry records rights in property; DHA administers immigration categories and permission for stated purposes. A title document is evidence about ownership, not your visa outcome. Assess the transaction and your intended stay separately. [B02C05]

This guide helps you prepare questions. It does not assess a particular property, draft a contract or offer conveyancing.

Start with the actual transaction

Record the property, proposed buyer, intended use and source of funds. Say whether the buyer would be you, joint purchasers or an entity. A holiday home, a main home, a rental property and premises for a business create different questions for the professionals assessing your plan.

Ask a conveyancer to explain what you are being asked to sign, what conditions protect the transaction and when your obligations arise. The Deeds Office’s transfer guide distinguishes conveyancing activities from deeds-registration activities and identifies an offer to purchase and consultation with a conveyancer at the start of the process. [B02C06]

Have the contract reviewed before relying on a promise that it can be cancelled if your move does not work out. Clarify the deposit, finance conditions, occupation arrangements and consequences of delay against the actual proposed terms.

Give each professional a clear question

What rights am I acquiring and what must happen for transfer?Conveyancer or appropriately qualified property lawyerProposed agreement, property particulars and buyer details
How will the purchase be funded and recorded?Your bank or authorised foreign-exchange provider, with the conveyancerFunding source, currency, buyer and intended transfer route

This table allocates questions; it does not guarantee that any proposed transaction is acceptable. Keep copies of the answers and identify assumptions that affect more than one part of the plan.

Check ownership and the total transaction budget

The Deeds Office explains that registration information can be checked through a deeds-office search or DeedsWEB. Ask the conveyancer to explain the registered ownership and any rights or restrictions relevant to the property, rather than relying only on a listing. [B02C07]

Budget beyond the advertised price. Request an itemised explanation of transfer, finance and professional charges, applicable tax, and ongoing property costs. SARS describes transfer duty as a tax on property acquisition, normally payable by the person acquiring it, with exceptions; the correct treatment must be determined for the transaction. Do not add a generic transfer-duty estimate to every purchase without checking the applicable tax treatment. [B02C08]

Ask when each amount becomes payable and who receives it. Confirm payment instructions using independently verified contact details before sending money, particularly if an account changes during the transaction.

Plan the immigration timeline alongside the purchase

Write down when you hope to occupy the property and what immigration permission that plan depends on. Include work, study or business activity rather than describing the whole plan as simply “living in my own home”.

Use the visa-topic overview to identify the relevant questions and the application-process guide to organise the evidence. Build a fallback if the property timetable and immigration outcome do not align. Ask the property professional what that would mean under your actual contract.

Worked example: occupation before a decision

Fictional planning example, not a client case or legal assessment. Priya wants to buy a flat and begin living there in September. Her immigration application is still being prepared. The proposed agreement includes an occupation date before the expected transfer.

She has the occupation clause, payments and insurance questions assessed by her property professional. Separately, she confirms what permission she would need for her intended stay and remote work. She asks what options the agreement gives her if she cannot occupy on the planned date, and records the costs of any alternative accommodation or delayed move.

She has not solved the immigration question by agreeing an occupation date. She has made the dependency visible while there is still time to make an informed contractual decision.

Common questions

Does buying a property mean I can remain indefinitely?

Do not use ownership as proof of immigration permission. Have your intended stay assessed through the relevant immigration category. The purchase and the permission serve different purposes.

Do I need a South African company to buy?

Do not set up an entity merely because someone calls it convenient. Ask for advice on the proposed buyer, legal capacity, tax and ongoing administration in your circumstances. The investment overview separates company ownership from immigration planning.

Will a transfer happen by a fixed date?

Ask which steps remain and who controls them. The processing-times guide concerns immigration targets, not a property-transfer promise. Keep the two timetables separate.

Your next useful step

Prepare one page with the proposed buyer, intended use, funding source, occupation date and immigration dependency. Take the property terms to the property professional and use prepare your first immigration conversation for the permission questions. Do not send sensitive financial documents to an unverified contact simply to make an initial enquiry.
