Permanent residence through family: identify the relationship ground first
Family-based permanent residence is not one application test. The Act distinguishes a spouse ground, child grounds and a first-step-of-kinship relative ground. [B05A01, B05A02] Start by identifying the particular relationship and the South African citizen or permanent resident through whom it is being examined.

Before you start
A temporary family visa and a permanent-residence application answer different questions. A family member's status, or a rule about changing a temporary visa, does not by itself decide your permanent-residence ground. Use this guide to organise the relationship evidence and the questions that need an individual review.
Match the relationship to the relevant provision
| Relationship being investigated | Statutory starting point | Preparation question |
|---|---|---|
| Spouse of a citizen or permanent resident | Section 26(b): five-year spouse relationship and good faith | What dates and evidence establish the relationship being relied on? |
| Child of a citizen or permanent resident | Section 26(c), with its age and later confirmation provisions | Which child provision applies to this person, and what dates require checking? |
| Child of a citizen | Separate section 26(d) | Can parentage and the parent's citizenship be established? |
| Relative of a citizen or permanent resident within the first step of kinship | Section 27(g) | What is the exact kinship link, and what records prove it? |
The spouse wording comes from the enacted 2011 amendment; the other listed grounds appear in sections 26 and 27 of the DHA-hosted Act. [B05A01, B05A02] This is a route-to-evidence map, not a finding that every relationship fits one of these grounds. Have the applicable child-age and confirmation rules checked for the individual's dates before relying on a child category.
The family overview and spousal-visa guide address separate temporary-permission questions. The permanent-residence overview explains the wider category choice.
The spouse ground is about the relationship, not just the wedding document
Section 26(b) requires five years as the spouse of the citizen or permanent resident and satisfaction that the spousal relationship is in good faith. It also contains an early lapse condition if that relationship ends within two years after issue, except through death. [B05A01]
Prepare a dated relationship account and identify what each record establishes. A certificate may establish a formal event. Other evidence may explain the relationship history or a period spent apart. Do not silently substitute the date you met, the wedding date or the date of a temporary visa for the legal question being examined.
Where the nature of the relationship, recognition of documents or the relevant start date is disputed, state the uncertainty plainly. A short factual explanation is more useful than a confident date chosen to make the application appear ready. This guide does not adjudicate recognition of a marriage or partnership.
After issue, regulation 23(6) provides for a departmental interview during the last six months of the second year for this spouse category. [B05A03] Put any actual conditions and follow-up instructions into a calendar; do not treat receiving the permit as the end of every obligation.
For parent and child cases, draw the relationship before collecting copies
Write the applicant and relevant citizen/permanent resident on a private family diagram. Identify which record proves each connection, which status is being relied on and whether names differ between documents. A surname shared across passports is not a full explanation of parentage.
For adoption, guardianship, changed names or a complicated chain of records, identify the specific question for the appropriate professional. Do not relabel a relationship because a different category looks easier. For section 27(g), the statute's first-step kinship wording is narrower than the everyday phrase "my family lives there". [B05A02]
Regulation 23(7) also requires the relevant citizen or permanent resident to satisfy the Director-General of their ability and willingness to support and maintain the relative for applications under sections 26(c), 26(d) and 27(g). [B05A03] Treat that as a separate evidence question, rather than assuming that proof of the relationship supplies every answer.
Build a relationship evidence index
Use one row per issue, keeping originals and sensitive information private until the recipient and process are established.
| Issue | What to record | Useful gap to flag |
|---|---|---|
| Identity | Current names and relevant earlier names | Different spelling across civil records |
| Relationship | Exact connection and relevant dates | Missing record linking two people |
| Anchor person's status | Citizenship or permanent residence relied on | Status document not yet located or unclear |
| Category-specific issue | Relationship duration, child dates or support question | Rule or date needing interpretation |
| Present permission | Each applicant's current status and expiry | Urgent expiry independent of the PR plan |
This is a preparation method, not a universal submission checklist. Obtain the current category and receiving-channel instructions through permanent-residence requirements. Do not order every document in an old family pack before establishing which ground is relevant.
Keep each person's status visible while waiting
DHA Directive 7 of 2026 expressly excludes permanent-residence applicants from its temporary concession and says they must keep residential status valid while awaiting the result. [B05A04] A PR receipt should therefore not be used as the household's entire current-status plan.
List each person's permission, intended activity and next review date. One family member's prospective ground does not establish the position of everyone travelling with them. Read individual immigration review if an expiry, activity change or pending decision needs separate attention.
Fictional example: one household, two different relationship questions
A couple is preparing a spouse-based review, while another household member is the adult child of a South African citizen. They initially collect one shared "family application" folder. They then separate the spouse's relationship history from the child's parentage and citizenship evidence, recording support and present-status questions individually.
The exercise helps them request a review of the actual grounds rather than assuming the spouse's five-year requirement applies to everyone. This fictional example does not determine eligibility, an age cutoff or whether applications can be lodged together.
Questions people ask
Does a South African spouse mean immediate permanent residence?
The spouse ground has its own five-year and good-faith conditions. [B05A01] A relationship is a starting fact, not a decision on an application.
Is a child of a permanent resident the same category as a child of a citizen?
The Act contains distinct provisions. [B05A02] Identify which is being relied on rather than importing a condition from a different child ground.
Does a temporary-family court judgment settle the PR application?
Do not assume that a decision about temporary status answers a different permanent-residence question. Ask what the judgment actually covers and which permanent-residence condition remains to be established. This page makes no case-specific litigation conclusion.
Can I rely on an old medical-report checklist?
Reconcile it with the July 2026 directive waiving the specified medical reports for future and pending applications. [B05A05] That directive does not remove every supporting document or health condition.
Prepare the relationship question
Write the exact relationship, relevant citizen/permanent-resident status, dates and largest evidence gap. Use conversation preparation to focus the review before paying for documents or assistance.
