Permanent residence through retirement: show the entitlement behind the income

If South Africa is intended to be a long-term home, the retirement ground for permanent residence deserves a separate evidence review. Receiving payments now is useful information, but the application needs evidence that meets the particular statutory basis.

Before you start

Section 27(e) addresses a person who intends to retire and has either the right to the specified pension, irrevocable annuity or retirement account giving the prescribed minimum payment for life, or the prescribed net-worth basis. Regulation 24(12) describes that asset basis as a combination of assets realising the prescribed monthly amount. [B05C05]

Temporary retirement permission and permanent residence are separate

The temporary retired-person visa under section 20 can be issued for up to four years at a time and renewed subject to its requirements. Permanent residence under section 27(e) is a different application. Temporary permission should not be treated as a promise that permanent residence will follow. [B05C06]

The distinction is not “temporary income versus lifetime income”. Section 20(1)(a) also uses lifetime-payment wording for its pension, irrevocable-annuity or retirement-account basis. Have the actual basis and evidence checked for the application you intend to make. [B05C07]

Read the retirement overview if you are still defining the household’s planned stay. This page focuses on the financial proof for the permanent ground.

Understand the monthly amount and the assets route

Government Notice 451 of 2014 applies the R37,000 monthly retirement amount to the cited temporary and permanent retirement provisions. Read it with Regulation 24(12): an asset-based case needs an explanation of assets realising the prescribed monthly amount. It is not a rule that a total capital balance of R37,000 establishes retirement eligibility. [B05C08]

The figure is not a complete eligibility result. Confirm the continuing applicable notice and the receiving office’s current requirements before submission. Avoid replacing the financial evidence with a statement that you can afford local living costs; the application asks a different question from your household budget.

Build an entitlement file, not just a bank-statement bundle

Ask for clarification of genuine gaps in the underlying records. Do not describe a discretionary distribution as guaranteed, omit a condition or change the name of a product to make it resemble the statute.

If several sources are being considered together, keep each source traceable from the explanatory schedule to the provider or ownership record and then to actual receipts. Explain a difference between the contract amount and the banked amount rather than hiding it among statements.

Keep your partner’s position and present status visible

Prepare a separate summary for each accompanying person: planned stay, work or study, present permission and the ground to be assessed. Do not assume the same financial record establishes everyone’s permission for every activity.

If you are in South Africa while waiting, maintain a separate current-status plan. DHA’s Directive 7 of 2026 excludes permanent-residence applications from its temporary concession and says applicants awaiting permanent-residence outcomes must keep residential status valid. A permanent-residence receipt is not your renewal plan. [B05C09]

Use permanent-residence processing times to prepare for the wait without relying on a guaranteed decision date.

Worked example: receipts without the governing terms

Fictional preparation example, not a client case or eligibility finding. An applicant has regular monthly bank receipts from a retirement provider and assumes that a year of statements proves everything needed for section 27(e).

She obtains the governing benefit terms and a provider letter explaining who is entitled, the duration, payment conditions and amount. She reconciles those records with the receipts and identifies a separate investment whose distributions vary. She does not describe the variable investment as a lifetime guaranteed pension.

The resulting file lets the proposed basis be assessed against the evidence. It is more useful than additional statements repeating the same unanswered question, but it is not an approval.

Common questions

Must I buy a particular annuity or investment?

This guide recommends no product. First understand the records you already have and the basis being assessed. A decision to acquire or alter a financial product needs its own appropriate advice.

Is retirement-based permanent residence the same as financial independence?

No. Section 27(f) is a separate ground. The financial-pathways comparison distinguishes income, capital and net-worth evidence without treating the tests as interchangeable.

Will a temporary retirement visa remove the permanent application’s requirements?

No automatic exemption should be assumed. Organise evidence for the specific application and identify what an earlier outcome actually establishes.

Your next useful step

Prepare the entitlement table and a short explanation linking each source to the records. Use the permanent-residence requirements guide to build the broader evidence index and prepare your first immigration conversation for the unresolved questions.
