Dual citizenship: check the two countries and the purpose of each document
Holding or acquiring another nationality raises more than one question. Check South Africa's current law, the other country's rules, your own citizenship record and the documents needed for the proposed journey. One country's answer does not decide the other country's nationality law.

Before you start
The major South African change is the Constitutional Court's 6 May 2025 judgment invalidating section 6(1)(a), the former automatic-loss provision linked to acquiring another citizenship without prior retention permission. Advice repeating that automatic-loss rule as current law is outdated. The judgment does not, however, remove every other citizenship provision or make every passport choice lawful. [B06B04, B06B07]
What changed — and what needs a separate answer?
In *Democratic Alliance v Minister of Home Affairs*, CCT184/23, [2025] ZACC8, the Court declared section 6(1)(a) invalid from 6 October 1995. People who lost citizenship by operation of that provision are deemed not to have lost it. The exact provision and the person's actual history matter. [B06B04]
If you are dealing with an old loss letter, a mismatch in DHA records or a missing retention certificate, use the retention and record-confirmation guide. That administrative task differs from planning a future acquisition of another nationality.
If you voluntarily renounced South African citizenship, do not assume the judgment undoes that act. The official reinstatement portal expressly excludes voluntary renunciation and conversion losses before 6 October 1995 from its judgment-based process. [B06B05]
Create a two-country question record
| Topic | South African question | Other country's question |
|---|---|---|
| Existing status | Is citizenship established and is the official record accurate? | Is the other nationality established and documented? |
| Proposed acquisition | Which current South African provisions apply to this event? | What are that country's acquisition conditions and consequences? |
| Renunciation | Is any declaration being requested, and what would its legal effect be? | Does the other country require renunciation or recognise an exception? |
| Children | What is each child's individual position? | Does the other country's rule treat children differently? |
| Travel | Which valid South African document and current instructions apply? | What document is needed for that country's entry, exit or transit? |
Record the source, date and exact answer for each side. Where a form asks for a declaration about another citizenship, read it before signing. Do not assume an informal promise to renounce and an effective legal renunciation are interchangeable. Obtain advice on the particular instrument and process.
This guide does not state that every country permits dual nationality. It also does not advise surrendering a nationality or timing an oath to fit a generic online example. Ask the competent foreign authority or an appropriately qualified professional to explain that country's rules for the intended acquisition.
Dual nationality does not settle the passport question
Section 26B, inserted by the 2004 amendment, addresses a major South African citizen entering or departing the Republic using another country's passport. It also addresses using foreign citizenship in South Africa to gain an advantage or avoid a responsibility or duty. This is a distinct provision from section 6(1)(a), which was invalidated in 2025. [B06B07]
Current Canberra guidance tells South African citizens, including dual citizens, to enter and exit South Africa with a valid South African passport. Read that official guidance with your confirmed status, the statutory scope and the responsible mission's current instructions before travelling. The loss judgment should not be presented as a general permission to use whichever passport is convenient. [B06B08]
If your South African passport has expired or the underlying record is unresolved, raise the document and status questions before booking a journey that depends on an assumption. An application receipt, old passport or citizenship confirmation letter should not be described here as automatically replacing a valid travel document. Ask the responsible authority what the particular document allows.
The UK mission's current civic-services page separates passport channels, identity prerequisites and other services. Its arrangements illustrate that service access also depends on the document and person's circumstances. Do not import that mission's fees, appointment channel or timing into an application elsewhere. [B06B12]
Keep citizenship, residence and tax questions distinct
A dual-citizenship discussion does not establish that a non-citizen family member can live or work in South Africa. Use the family overview or visa overview for their separate status question.
Nor should holding two passports be used as a substitute for a tax-residence assessment. If your plans involve relocation, employment, business or assets across borders, identify the relevant tax and financial questions separately. This page does not decide tax residence, tax liability or access to a particular bank product from nationality alone.
For children, prepare a separate record of birth, parentage, relevant citizenship dates and registrations. A parent's current dual status should not be treated as an automatic finding for every child. The citizenship-through-a-parent guide explains the evidence task.
A worked decision example
Illustration only — fictional people, not an approval or travel story. Thandi is a South African citizen considering naturalisation elsewhere. An old mission page says she must first obtain retention permission or lose citizenship. She checks that sentence against the 2025 judgment and then separates her remaining tasks.
She asks the foreign authority about its own dual-nationality and declaration requirements. She checks her South African status record and passport validity, and asks the responsible mission about the intended journey. Her child's position is a separate enquiry. The example does not establish that the foreign country will accept dual nationality or that a particular passport is sufficient for the journey.
Common questions
Must I still follow the old automatic-loss retention advice?
The former section 6(1)(a) rule was invalidated by the Constitutional Court. Do not treat a still-visible old checklist as overriding that judgment. Ask how any remaining instruction relates to current law and your actual circumstances. [B06B04]
Does the judgment cancel a voluntary renunciation?
The official judgment-based portal expressly excludes voluntary renunciation. A separate history and procedure may need assessment. [B06B05]
Can I now choose either passport for South African entry and exit?
Do not infer that from the judgment. Section 26B and current official passport guidance address a separate issue. Verify the appropriate current documents before travel. [B06B07, B06B08]
Does dual citizenship apply automatically to my spouse?
Do not assume one person's nationality determines another's. Each person needs an individual citizenship or immigration assessment.
Your next action
Write down the intended nationality event, the other country, the dates, current South African records and proposed travel. Seek a precise answer for each question rather than asking only whether dual citizenship is “allowed”.
