Life-partner immigration questions: make your relationship history clear
For an unmarried couple, preparing an immigration enquiry means explaining the relationship accurately, not finding a document that makes the uncertainty disappear. Start with the status of the person you are joining, the history of the partnership and what you each want to do in South Africa. The term “life-partner visa” does not itself decide the legal category, evidence or activity permission.

Before you start
This page focuses on the evidence-preparation task for an unmarried partner of a South African citizen or permanent resident. For the wider residence and activity distinction, read the spousal visa overview. If your partner is a foreign temporary-visa holder, use the accompanying-family guide instead.
What does the published relationship framework ask for?
Regulation 3, substituted in the November 2018 amendment, addresses an applicant asserting the permanent-partnership limb of the statutory spouse definition in relation to a citizen or permanent-residence holder. Its published evidence includes a notarial agreement attesting that the exclusive relationship has existed for at least two years before application, the prescribed affidavit, and records of shared support and responsibilities. The enacted 2024 amendment expressly identifies the 2018 notice in the regulations' amendment history. [B03B01, B03B02]
That is a specific framework, not a general rule that any two people who shared an address for two years qualify. Equally, the relationship-duration wording should not be casually rewritten as an identical cohabitation rule for every applicant. Your reviewer must establish the relevant definition, current requirements, circumstances and any applicable exception before advising on your case.
Build the chronology before ordering documents
Write a factual sequence in your own words. Include when the relationship began, when shared arrangements started, any periods apart, and any earlier marriage or partnership relevant to civil status. Be precise about what you know and mark uncertain dates rather than improving them to suit an application.
| Part of the history | Useful preparation | A gap to discuss openly |
|---|---|---|
| Beginning and development | Date range and the records that already exist | Different recollections or limited early records |
| Shared living arrangements | Addresses and dates, including separate addresses | Work, study or care responsibilities causing separation |
| Shared responsibilities | What each partner contributes and how that is evidenced | Informal arrangements or one partner paying most costs |
| Earlier relationships | Relevant official divorce or death records, if applicable | An unresolved legal or documentary issue |
| Current plans | Where you intend to live and intended work/study | A proposed activity with no confirmed permission |
This table is a preparation method, not a scored test. A clear explanation of a gap can be more useful in a professional discussion than a large bundle of unexplained records. It does not guarantee that the gap can be overcome.
A notarial agreement and supporting evidence do different jobs
The published framework asks for a formal declaration and evidence of the underlying relationship. Signing a document does not turn an inaccurate history into a qualifying one. Regulation 3 also addresses previous marriage dissolution evidence and, where applicable, recognition of a relationship formed between foreigners abroad. Ask which formalities apply to your facts before arranging a notarial appointment. [B03B01]
Shared leases, household accounts and records of financial responsibilities can help you identify what exists, but a list of examples is not an assurance of evidential sufficiency. Keep the original source, date and the point each record illustrates. Avoid attaching years of private correspondence merely because you are unsure what matters.
Canberra's mission checklist provides a practical example of how a receiving office describes relationship and co-residence evidence. Its local instructions are not a substitute for the applicable national framework or another office's current requirements. [B03B03]
Keep activity questions separate from relationship evidence
Even a well-documented partnership does not answer whether you may start a particular job, study programme or business. Describe the actual activity and ask what authorisation would be needed. “I will help my partner” is too vague if it involves employment, business operations or income-producing work.
Prepare two separate questions: “What relationship evidence fits the proposed category?” and “What permission is required for my intended activity?” Use the work or study overview to organise that second question. Do not plan a start date from a relationship affidavit alone.
If circumstances change, ask before assuming the result
The relationship framework includes continuing-relationship reporting provisions. A change of circumstances should be reviewed against the actual visa and current law, not hidden because a renewal is approaching. [B03B01]
Where a relationship has ended and a South African citizen or permanent-resident child is involved, the Constitutional Court's *Rayment* order is important. It addresses specified parental circumstances and related residence/work restrictions. It is not a blanket answer for every breakup or family. Seek individual review before making decisions about work, remaining in South Africa or travel. [B03B06]
A fictional example: explaining time apart
Illustration only — not a client or approval story. An unmarried couple has a long relationship but spent part of it in different cities for work. They initially assemble a photo folder and call it proof of living together. Instead, they prepare an honest chronology, distinguish shared-address periods from time apart, and identify their financial and practical responsibilities. They ask which legal definition and evidence apply to that actual history. The result is a clearer enquiry, not a finding that their arrangement meets the requirements.
Common questions
Is two years at one address enough on its own?
No such conclusion follows from the published framework. It asks about the relationship and supporting evidence; an address alone does not settle the legal and factual requirements. [B03B01]
Should we marry just to simplify the paperwork?
This guide cannot make that personal or legal decision. Ask how the rules apply to your current relationship rather than changing a major life decision to fit an assumed shortcut.
Does an affidavit remove the need to explain missing records?
Do not assume it does. Identify the gap and ask what the receiving authority can accept. Formal statements and supporting records have distinct purposes. [B03B01]
Can we apply inside South Africa?
That needs review of your current status and proposed category. *Nandutu* addressed in-country-change exclusions for foreign spouses and children of citizens or permanent residents, but it does not resolve every status defect or application. [B03B07]
Your next useful step
Prepare one private page of relationship dates, existing evidence and unanswered activity questions. Use the first-conversation guide, then ask any proposed professional to clarify their responsibility and scope. Do not upload intimate records simply to obtain general reading guidance. No Karoo assessment or representation service is promised here.
