Naturalisation in South Africa: identify the ground before counting years
Naturalisation is an application to acquire citizenship. It is separate from obtaining permanent residence, confirming citizenship you already hold, or correcting a record affected by the former automatic-loss rule. Time in South Africa alone does not turn a visa or permanent-residence document into citizenship.

Before you start
For an ordinary section 5(1) enquiry, start with the permanent-residence record, the relevant ordinary-residence period, travel history and the other statutory requirements. Then check the current application procedure and documentary evidence with DHA. A “five years” summary is only one part of that task. [B06B09, B06B10, B06B01]
Establish whether naturalisation is the right question
Someone born to a South African parent may need confirmation of an existing status under the birth provisions rather than naturalisation. Someone affected by section 6(1)(a) may need the judgment-based record process. Do not choose a new acquisition application simply because an existing record is incomplete.
Use the citizenship-through-a-parent guide or retention and record-confirmation guide where appropriate. If your objective is first to obtain permanent residence, start with the permanent-residence overview.
Naturalisation itself also contains different grounds. The ordinary adult route, provisions concerning a minor, a spouse or surviving spouse, and the section 4(3) application for a qualifying person born in South Africa should not be treated as one interchangeable test. Identify the actual section before using a checklist. [B06B01, B06B03, B06B10]
What does the five-year rule establish?
Government Notice 3535 of 12 June 2023 amended regulation 3(2)(a) to specify five years of ordinary residence immediately before the application for the period referred to in section 5(1)(c). This is an enacted amendment. It should not be confused with a later document headed as a proposed amendment, or with the older ten-year wording it replaced in that paragraph. [B06B09]
That change does not make any five calendar years since arrival sufficient. The Act addresses permanent residence and ordinary residence, and the regulations separately address absences. The remaining regulation 3(2)(b) and (c) wording refers to absence exceeding 90 days in a year during the relevant five-year period. Have the actual residence ground, dates, absences and applicable interpretation assessed together rather than relying on a website counter. [B06B03, B06B09, B06B10]
Do not assume temporary-visa years, tax residence, a property purchase or a South African address answers the citizenship residence test. Those records may describe real circumstances but need to be connected to the statutory enquiry. Keep the actual permit history and travel movements alongside the ordinary-residence evidence.
Prepare an evidence file with a reason for each record
| Evidence group | What to assemble privately | Question it helps answer |
|---|---|---|
| Permanent residence and identity | Permit, identity records and relevant official verification | What status was held and from when? |
| Residence chronology | Addresses, periods abroad and supporting dated records | Which period and pattern of ordinary residence is being assessed? |
| Travel | Passport records and a departure/return schedule | Are the absences complete and consistent? |
| Character and current circumstances | Relevant official records and truthful application answers | What does the applicable statutory and documentary assessment require? |
| Language and civic responsibilities | Current requested evidence | How will the relevant statutory knowledge and communication requirements be shown? |
| Family or other special ground | Relationship, birth or other ground-specific documents | Is a different provision applicable? |
The 2023 amendment adds supporting evidence concerning knowledge of an official language, a permanent-resident identity document, employment and its duration, and fixed property if any. “If any” should not become an invented requirement that every applicant must buy property. Nor should a list of requested employment evidence be presented as a promise that a job guarantees citizenship. [B06B09]
The original Act and its amendments contain requirements beyond residence, including character, intended continued residence, communication in an official language and knowledge of citizenship responsibilities and privileges. Use the current applicable wording and receiving instructions for the particular ground rather than treating this guide as a complete legal consolidation. [B06B10, B06B01]
Where a record is missing, identify the issuer and ask what accepted replacement or explanation is available. Do not reconstruct travel dates from memory and present them as verified. If the records disagree, preserve both versions and the discrepancy for resolution.
Keep another nationality and renunciation separate
Before signing any declaration, establish what it does under South African law and the other country's law. The naturalisation provisions address the other country's approach to dual citizenship, while the 2025 automatic-loss judgment concerns a different provision and a different situation. Do not infer that the judgment removes every acquisition or foreign-nationality condition. [B06B01, B06B04]
Obtain an explanation of any conditional approval and its remaining steps. Do not renounce another nationality merely because an educational article mentions renunciation. The person's actual other-country rules, documents and timing need specific assessment. The dual-citizenship guide separates those questions.
Policy reform is not the same as an operative application rule
In April 2026 DHA announced Cabinet approval of a revised White Paper, including a proposed merit-based approach, an annual application window and a points-based economic pathway. The announcement also says the policy is to be converted into legislative amendments. Cabinet approval of a policy document should not itself be advertised as an enacted points-based citizenship route or a currently available annual application process. [B06B11]
Ask which enacted provision and current administrative instruction governs the application you intend to make. This guide does not certify that an announcement has changed the law merely because its wording describes reforms in the present tense.
A worked preparation example
Illustration only — fictional person, not a naturalisation success story. Farid has lived in South Africa for several years, first on temporary visas and later as a permanent resident. He initially counts from his first arrival. His preparation schedule separates temporary status, the permanent-residence grant, ordinary-residence evidence and trips abroad.
He asks which period is relevant to his actual ground and whether the absences affect it. He obtains the current document instructions and raises the other nationality's requirements before signing any declaration. The example does not calculate an eligibility date or promise approval.
Common questions
Is five years of permanent residence an automatic entitlement?
No automatic acquisition follows from that summary. The applicable ground, residence test, absences, other requirements and decision process still need assessment. [B06B09, B06B10]
Does marrying a citizen make me a citizen?
Do not confuse a relationship with an automatic grant. The Act contains specific provisions that need to be assessed with the person's residence and circumstances. [B06B01, B06B10]
Can every family member be included on the same basis?
No such assumption is safe. The regulations require family members included in an application to qualify, and minors have their own statutory provision. Check each person. [B06B03]
Does filing make me a citizen or issue a passport?
A naturalisation application is not a grant or a passport. Establish the decision, certificate and remaining formal steps before treating citizenship as acquired. [B06B01]
Prepare the next action
Bring the proposed statutory ground, permanent-residence history, complete travel chronology, evidence gaps and other-nationality question to the appropriate review. Keep sensitive records private until the responsible recipient and secure process are clear.
Continue with the citizenship overview and preparing a first conversation.
