South African business visa: what the evidence needs to establish

A business visa is an immigration route for a person establishing or investing in a South African business in which they may be employed, subject to the statutory requirements. [B04A03] Registering a company, buying shares or signing a property transaction should not be treated as the visa decision itself.

Before you start

This guide explains the main evidence questions. It does not approve a business, assess an investment, guarantee a waiver or offer a Karoo company-formation service.

Define the business and your own role

Separate the commercial proposal from the personal immigration question. Describe what the business does, whether it is new or existing, the proposed investment, the ownership structure and what you personally intend to do in South Africa.

A passive ownership question, employment in an unrelated company and establishing a business are different arrangements to have reviewed. Start with the investment orientation or work routes if the activity is still unclear. A company name or a purchase price is not a substitute for that factual description.

What the capital notice actually says

Notice 560 of 15 July 2014 determines the cash amount originating outside South Africa, to be invested in a new or existing business, as R5,000,000. It separately states that the capital contribution must be new machinery or equipment. [B04A04]

Read this together with the relevant regulation's cash/capital evidence and any exact applicable reduction or waiver. Do not assume that any asset, share price, property value or money temporarily shown in an account automatically satisfies the prescribed contribution. The actual structure and supporting certificate need appropriate examination.

The regulation calls for a certificate from an appropriately registered chartered or professional accountant addressing the prescribed availability/investment evidence. [B04A05] A self-prepared valuation or sales brochure is a different kind of document. Establish which professional will examine the actual contribution and what records they need before presenting a transaction as immigration-ready.

New and existing businesses do not have identical evidence

Comparison of Evidence area, New/not-yet-established business, Established/existing business
Evidence areaNew/not-yet-established businessEstablished/existing business
Financial/capital positionPrescribed certificate addressing available contributionCertificate addressing the relevant available/already-invested contribution
StaffingUndertaking about the prescribed permanent South African citizen/permanent-resident staff proportionProof of the corresponding existing staffing position
RegistrationsRelevant undertakings, with applicable registration evidence to followProof of relevant registrations
Existing investmentThe proposed business and contribution need a clear explanationRegulation 14(3) adds preceding-year financial statements and proof of investment

These distinctions come from regulation 14 and are not a complete universal checklist. [B04A05] The regulation's staffing provision uses 60% of the total staff complement in the specified permanent citizen/permanent-resident positions, with specified follow-up requirements. It also provides for a recommendation addressing feasibility and national-interest contribution from the department responsible for trade and industry. [B04A05]

Give these workstreams actual owners. A business plan may explain a proposal, but it is not itself the statutory recommendation, accountant's certificate or evidence of registrations. Ask how forecasts will be distinguished from facts already established.

A capital waiver needs an actual basis

Section 15(3) gives a power to reduce or waive the prescribed financial/capital contribution in the defined circumstances. Notice 562 identifies businesses qualifying for consideration under the national-interest framework, including detailed sectors and activities. [B04A03, B04A06]

A broad industry label is not a granted waiver. Compare the actual activity with the exact notice and establish what decision or evidence is required for the case. Do not assume that being described as “technology” or “tourism” waives every condition. A capital reduction also should not be recast as an automatic waiver of staffing, registration or other requirements.

Check exclusions before making a commitment

The Act provides for undesirable business undertakings, and Notice 561 lists specific undertakings for this business-visa purpose, including the security industry, exotic entertainment and the stated second-hand-vehicle import-for-re-export activity. [B04A03, B04A07] Do not confuse that notice with the separate corporate-visa exclusion list.

Have a borderline activity examined before committing money on the assumption that the route is available. This guide does not decide an industry's classification or the legality or commercial merit of the underlying business.

The visa has its own limits after a commercial transaction

Section 15(2) limits work to that related to the business for which the visa was issued. [B04A03] A business visa should not be described as unrestricted permission to take any job. A changed business or role needs attention to the actual permission and current rules.

Keep company registration and ownership filings in their own workstream. The company-registration guide explains why corporate records and personal permission are separate questions. The employer guide addresses staff coordination if the business will employ foreign nationals.

Fictional example: the purchase price does not explain the contribution

A buyer receives a proposal to purchase an operating business. The seller's price bundles several items, while the immigration capital evidence has not been analysed. The buyer separates the transaction documents, source of funds, proposed personal role and accountant's questions before treating the price as proof of the prescribed contribution. This fictional example does not value the business, establish compliance or recommend the purchase.

Questions people ask

Is R5 million the total cost of obtaining a business visa?

No. The notice concerns the prescribed contribution, not an all-inclusive fee or investment recommendation. [B04A04] Separate business expenditure, contribution evidence and application/assistance charges using the cost guide.

Can I assume a sector listing gives me a waiver?

No waiver decision is made here. Identify the exact listed activity and applicable decision/evidence under the framework. [B04A03, B04A06]

Is a company certificate enough?

It answers a corporate registration question. The business route has separate personal and business evidence requirements. [B04A03, B04A05]

Should I use every document on a mission's old checklist?

Use the instructions applicable to the actual category/channel and reconcile later instruments. For example, the July 2026 directive waived specified medical-report requirements, not every supporting item. [B04A02] No universal bank statement, fee, medical or processing-time instruction is given here.

Prepare the business evidence conversation

Write one paragraph on the actual activity and your proposed role. List the contribution question, business stage, staffing and any claimed waiver separately. Use conversation preparation and choosing assistance to assign the right professional task before commitments.
