Remote work from South Africa: separate the employer, visa and tax questions

The gazetted remote-work provision concerns work conducted remotely for a foreign employer. The October 2024 regulation sets an earnings condition and specific SARS registration clauses. [B04A01] It is not a general permission for every person with a laptop to take a South African job or run any business they choose.

Before you start

Use this guide to identify the arrangement and evidence that need review. It does not assess your application, determine tax residence or promise a tax-free stay.

Start with who employs you and what you will actually do

Describe the employing entity, its location, your contract and the activities you intend to conduct from South Africa. Separate an overseas employment relationship from a proposed local job, a transfer to a South African group company, self-employment or operation of a business.

Those differences should be examined before treating “remote worker” as the answer. The work overview covers local-employment route questions; the intra-company transfer guide addresses a group assignment. For establishing or investing in a business in which you may work, read the business-visa guide.

A mixed plan needs particular clarity. If an overseas role will continue but you also propose another local activity, record both. This page does not decide that the additional activity is covered by the remote-work provision.

Use the enacted income figure, not an old headline

Notice 5398 of 9 October 2024 substitutes regulation 11(4)(b). It specifies earnings of no less than the equivalent of R650,976 per annum for the remote work it describes. [B04A01] That is a gazetted annual condition, not a household budget, a processing fee or an approval guarantee.

Prepare accurate evidence of the employment and earnings you are asking to have reviewed. Where currency conversion or irregular remuneration matters, identify the actual evidence and the interpretation that needs clarification; do not assume that an informal monthly conversion or a projected bonus settles the requirement.

Some checklists and older material use different figures. Resolve a discrepancy against the applicable enacted instrument and current responsible-office guidance rather than choosing the amount that is easiest to meet. This guide uses the October gazette, not an earlier proposal or an inconsistent checklist figure.

Understand the registration clauses precisely

The same regulation distinguishes two situations:

  • If the person is tax resident in a country with the relevant double-taxation agreement in force with South Africa, it requires SARS registration when presence exceeds an aggregate 183 days during any 12-month period.
  • If the person is not tax resident in a country described by that clause, it provides a separate SARS registration requirement without the same 183-day qualification. [B04A01]

These are registration provisions within this immigration regulation. They are not a complete tax-residence test, a blanket 183-day tax exemption or a conclusion about what tax an individual owes. An agreement's existence, your tax residence, the applicable treaty provisions and the actual income arrangement need their own review.

Maintain an accurate private record of time present, employment and the tax-residence position being relied on. Ask the appropriate tax professional or SARS which obligations apply to you and, where relevant, your employer. Use the tax-residence guide and tax-registration overview for further reading. No personal tax result is calculated here.

Separate permission from the practical remote-work plan

An employer's consent to work abroad, the immigration permission, tax obligations and the practical ability to do the job are different workstreams. Agree who will examine each before committing to accommodation or a travel date.

For the practical side, check the actual address's connectivity and any work arrangements needed by the employer. For living costs, obtain current quotes rather than assuming the income condition indicates what your household will spend. The living-cost guide provides a quote-based method.

This guide does not claim that every employer can support cross-border work without further obligations, or that a remote-work visa resolves company registration, employment, insurance or tax questions for the employer.

Prepare a current, channel-specific evidence index

Use the visa-requirements guide to identify the instructions for the actual category and filing location. Record the requirement, evidence owner, current source and unresolved issue. Do not reuse a general-work application pack simply because both plans involve work.

Read older checklists with later instruments. The July 2026 directive waives the specified medical-report requirements within its scope. [B04A02] This does not remove every supporting document, health or vaccination condition. Fees and bank/document instructions also need checking for the actual channel; no universal list or amount is supplied here.

Fictional example: two separate questions behind one plan

A person employed by a company abroad wants to spend part of the year working from South Africa. They also receive a proposal for unrelated local work. They separate the overseas contract, proposed local activity and tax questions rather than assuming that “remote” covers the whole plan. The fictional example does not determine whether either activity qualifies or what the person owes in tax.

Questions people ask

I searched for a "digital-nomad visa". Where should I start?

Do not infer the applicable category from a search label. This guide examines the foreign-employer remote-work provision in regulation 11(4)(b). [B04A01] Start by describing who employs you and what you intend to do. A local role, group transfer or business activity needs its own investigation; the label does not resolve those differences.

Is this the same as taking a local job from a home office?

The provision describes remote work for a foreign employer. [B04A01] A local employment arrangement needs its own route analysis; the location of the desk does not settle it.

Does meeting the earnings condition guarantee the visa?

No individual determination is made here. The earnings clause is part of the relevant framework; your actual circumstances, evidence and other applicable requirements still need examination.

Does being present fewer than 184 days mean I owe no South African tax?

This guide makes no such conclusion. The registration clauses have a defined context and do not replace the separate tax analysis. [B04A01]

Does a change in employer or activity matter?

Have the actual permission and changed arrangement reviewed before assuming coverage. The individual activity-review guide helps organise the facts without determining the result.

Prepare a focused review note

Record your actual employer, proposed activities, earnings evidence, presence plan and tax question. Then use conversation preparation to identify which question belongs to the immigration reviewer and which needs tax expertise.
